2. Acceptance of These Terms
These Terms govern your use of hermionedepaula.com and any order placed through the website.
By using the website or placing an order, you agree to these Terms together with our Privacy Policy, Shipping Policy, Returns Policy and Made-to-Order Cancellation Policy.
If you do not agree to these Terms, you should not use the website or place an order.
Nothing in these Terms limits or excludes any statutory rights that cannot lawfully be limited or excluded.
3. Website Use
You may use this website only for lawful purposes. You must not:
- Use the website fraudulently or unlawfully
- Attempt to interfere with its security or operation
- Introduce malicious software or harmful code
- Access restricted areas without authorisation
- Copy, reproduce or commercially exploit website content without permission
- Use automated systems to extract website content or data without written consent
We may suspend or restrict access where we reasonably believe these Terms have been breached.
4. Product Information
We take reasonable care to ensure that product descriptions, measurements, prices and images are accurate. However:
- Colours may appear differently depending on the device or screen used
- Handmade pieces may display minor variations
- Embroidery placement and artisanal details may vary slightly between pieces
- Measurements are approximate unless expressly confirmed otherwise
- Archive pieces may show signs of age, previous use, handling or storage
Known marks, blemishes or condition issues affecting Archive pieces will be described or shown where reasonably possible.
Please contact us before purchasing if you require additional photographs, measurements, condition information, sizing guidance or other details.
5. Product Categories
Ready-to-Ship Items
Ready-to-ship items are physical products currently available for dispatch, including Prêt-à-Porter pieces, embroidery accessories and other in-stock goods.
Availability is subject to change. Placing an item in your bag does not reserve it.
Made-to-Order Pieces
Made-to-Order pieces are individually produced after an order has been placed, based on the size and options selected by the client.
Please allow up to 14 weeks for creation, plus any additional time required for final fittings, alterations and shipping. Lead times are estimates and may vary according to the design, materials, customisations and Atelier capacity.
Custom and Couture Projects
Custom and Couture projects may be governed by a separate written proposal, payment schedule or client agreement. Where separate written terms have been agreed, those terms will take priority over these Terms to the extent of any conflict.
Archive Pieces
Archive pieces are unique and are sold in their existing condition. Their age, history and previous use form part of their individual character.
6. Orders and Contract Formation
By placing an order, you are offering to purchase the selected products in accordance with these Terms.
You will receive an electronic acknowledgement after placing your order. A contract is formed when we confirm that your order has been accepted.
We reserve the right to decline or cancel an order before acceptance where:
- The product is unavailable
- The price or product information contains an obvious error
- Payment cannot be authorised
- We cannot deliver to the supplied address
- We reasonably suspect fraud or unauthorised activity
- We are unable to fulfil the order for another legitimate reason
If payment has already been collected for an order we cannot accept, the relevant amount will be refunded.
7. Prices, VAT and Currency
Website prices originate in pounds sterling. Prices displayed in other currencies may be converted using Shopify’s applicable exchange rate and may change as exchange rates fluctuate.
The final price and currency payable will be shown at checkout.
UK prices include VAT where applicable. If the applicable VAT rate changes, we may adjust prices accordingly.
We may correct an obvious pricing error before accepting an order. If an error is discovered after an order has been placed, we will contact you and offer the choice of proceeding at the correct price or cancelling the order for a refund.
8. Shipping, Duties and Taxes
Ready-to-Ship Items
For ready-to-ship physical items, applicable duties and taxes are included in the displayed price.
Shipping is charged at the following fixed rates:
- United Kingdom: £25, complimentary on orders over £250
- EU and Rest of World: £50, complimentary on orders over £500
Made-to-Order, Couture and Archive Pieces
Displayed prices for Made-to-Order, Couture and Archive pieces exclude packing, shipping, customs duties, import taxes, tariffs and other destination charges.
These charges vary according to the location of the piece, delivery destination and required service. An estimated quotation or fully landed price is available upon request.
Any charges included in an individual quotation must be agreed and paid in full before dispatch. Charges not expressly included remain the customer’s responsibility and may be collected by the courier or local customs authority.
Full details are provided in our Shipping Policy.
9. Payment
Payment must be made using one of the methods offered at checkout.
Full payment is normally collected when an online order is placed. Custom, Couture or other individually agreed projects may be subject to a separate deposit or staged-payment schedule.
You confirm that you are authorised to use the payment method provided. Payment information is processed securely by Shopify and the relevant payment provider.
We may undertake reasonable fraud-prevention checks and request proof of identity before accepting or dispatching an order.
10. Delivery
Delivery estimates begin from dispatch and do not include Made-to-Order production, fittings or alterations.
Our standard international delivery timeframe is up to 15 working days from dispatch. Delivery dates are estimates and cannot be guaranteed.
We are not responsible for delays caused by customs authorities, couriers, incorrect delivery details or circumstances beyond our reasonable control.
Please ensure that the delivery address and contact information provided are complete and accurate. Additional storage, redelivery or return-to-sender charges caused by an unsuccessful delivery may be invoiced separately.
11. Sizing, Fittings and Alterations
Made-to-Order pieces are created in the selected standard UK size unless a separate custom agreement states otherwise.
It is your responsibility to review our Size Guide and provide accurate information when requesting sizing guidance or custom work.
Final fittings and alterations are not included in Made-to-Order or Archive prices. We may provide a separate quotation at one of our locations or, where possible, recommend a trusted specialist in your area.
We cannot accept responsibility for alterations undertaken by an unauthorised third party.
12. Made-to-Order Changes and Cancellations
Please contact us immediately if you wish to amend or cancel a Made-to-Order purchase.
Changes to size, colour, design or customisation cannot be guaranteed after an order has been placed. An approved amendment may affect the price and lead time.
Once production has commenced—including material allocation, cutting, embroidery or construction—the order cannot normally be cancelled or changed.
Made-to-Order and personalised pieces may not qualify for change-of-mind cancellation or return rights where they have been made to the customer’s specifications or clearly personalised. This does not affect any rights relating to faulty, misdescribed or otherwise non-conforming goods.
Please review our Made-to-Order Cancellation Policy before ordering.
13. Returns and Refunds
Returns and refunds are governed by our Returns Policy and applicable consumer law.
Ready-to-ship items purchased online may qualify for statutory cancellation rights. Different rules may apply to personalised, custom-made and Made-to-Order pieces.
Archive pieces are sold in their disclosed existing condition. Nothing in an Archive description excludes rights relating to faults or material differences that were not disclosed before purchase.
Original shipping charges, duties, taxes, tariffs and customs-clearance charges are non-refundable except where required by law.
Nothing in these Terms affects your statutory rights.
14. Faulty or Misdescribed Products
If an item arrives faulty or materially different from its description, please contact info@hermionedepaula.com promptly.
Please provide:
- Your order number or proof of purchase
- A description of the issue
- Clear photographs showing the fault
Following assessment, we may offer a repair, replacement, price reduction or refund as appropriate under the circumstances and applicable law.
Do not wear, alter, repair or damage the item while a claim is being assessed. Please retain all labels and original packaging.
15. Intellectual Property
All content on this website—including text, photography, video, graphics, logos, artwork, embroidery designs, prints, patterns, product designs and other creative material—is owned by or licensed to Hermione de Paula and is protected by intellectual-property laws.
You may view the website for personal, non-commercial use. No content may be copied, reproduced, modified, distributed, published, commercially exploited or used to create derivative works without prior written permission.
Purchasing a product does not transfer any intellectual-property rights in its design, artwork or embroidery.
16. Third-Party Services and Links
The website may contain links to or integrations with third-party services, including payment providers, couriers and external websites.
We are not responsible for the content, availability, security or privacy practices of third-party websites. Your use of a third-party service may be governed by that provider’s own terms.
17. Privacy
Personal information is handled in accordance with our Privacy Policy.
We may share information with payment processors, couriers, professional advisers and service providers where reasonably necessary to process payments, fulfil orders, prevent fraud or meet legal obligations.
18. Liability
We do not exclude or limit liability where doing so would be unlawful, including liability for:
- Death or personal injury caused by negligence
- Fraud or fraudulent misrepresentation
- Breach of statutory consumer rights
- Any other liability that cannot legally be excluded
If you are a consumer, we are responsible for losses that are a foreseeable result of our breach of these Terms or failure to use reasonable care and skill. We are not responsible for losses that were not reasonably foreseeable.
We are not responsible for business losses—including loss of profit, revenue, opportunity or goodwill—where products were purchased wholly or mainly for personal use.
19. Events Beyond Our Control
We are not responsible for delay or failure caused by events beyond our reasonable control, including natural disasters, fire, flood, epidemic, industrial action, transport disruption, customs delays, interruption of utilities, supplier failure, governmental action or restrictions on international trade.
Where such an event materially affects an order, we will contact you and take reasonable steps to minimise the impact.
20. Changes to These Terms
We may update these Terms from time to time. The version applicable to an order will be the version published when that order was placed, unless a change is required by law.
The latest revision date will appear at the beginning of this policy.
21. Severability and Waiver
If any part of these Terms is found to be unlawful or unenforceable, the remaining provisions will continue in effect.
A delay or failure to enforce any provision does not waive our right to enforce it later.
22. Governing Law
These Terms are governed by the laws of England and Wales.
If you are a consumer living elsewhere, you retain any mandatory protections provided by the laws of your country of residence. Nothing in this section prevents you from bringing a claim in a court available to you under applicable consumer law.
